For foreign organization registering a Trade Mark in India, application must be filed with registry within whose territorial limits the place the place for service is situated.
Here are steps that are followed after application of trade mark registration:
- Application number is allocated to the trade mark application
- Data for trade mark is entered in to the database
- Trade mark is scanned and codification is done
- Examination: The applied trade mark is then examined for the following:
- Trade mark capability of being respected graphically
- Trade mark is capable of distinguishing the goods or services
- Trade mark does not conflict with exiting registered or pending Trade Marks
- Trade mark registration is not prohibited under other provisions of the act
- An examination report is issued with acceptance or rejection note.
- If Trade mark is accepted then it is published in Journal Publication
- Trade mark registry then wait for any opposition from others
- If no opposition is raised then Trade Mark is registered in the name of the applicant
