- Trade Mark should be unique. Common words should not be used unless they are part of the slogan.
- Trade Mark must be accompanied with other details like colors, forms, or three-dimensional features.
- Trade Mark should represent the product and services uniquely, so that your customers can link it with the product and services.
- Trade Mark should not be misleading. Your Trade Mark should not mislead the customers about the product or services quality or its origin.
- Trade Mark must not belong to the exclusions provided by the law. It must not be a photograph, drawings or names of people or places unless they can be shown to be particularly distinctive.
- Trade Mark must not be offensive to public order and morality.
- A list of goods or services to which the Trade Mark is attached must also be attached with the application.
- Application for registration must be applied with the appropriate national or regional trade mark office.
- Application must contain a clear reproduction of the mark filed for registration.
- The concerned office/department on receipt of the application assigns a date (of application) to the application. After this they examine the feasibility of its registration.
