What is Patent?

Patent is an exclusive property right provided to the inventor and/or the applicant that prevents others from exploiting the invention mentioned in the patent. The term for a new patent is granted for maximum 20 years by the state after a complete disclosure of the invention given in the patent.

The right provided to the inventor are, “the right to exclude others from making, using, offering for sale, or selling” the invention in the United States or importing the invention into the United States. What is granted is not the right to make, use, offer for sale, sell or import, but the right to exclude others from making, using, offering for sale, selling or importing the invention.

Patent gives an exclusive right to the person who has invented a new item (or improved an existing item or a new process of making the item), the exclusive right to manufacture item according to invented process for a limited period (maximum 20 years). Law prevents other person from using the patented invention during the term of the patent. After the expiry of the term of the patent the invention become public and anybody can use it.
